Health and Safety trial result

The Office of the Commissioner has this afternoon been found guilty of failing to discharge a duty under Section 3 Health Safety Act 1974 in relation to the circumstances leading up to the death of Jean Charles de Menezes at Stockwell Underground Station in July 2005. In sentencing the Judge ordered a £175,000 fine with £385,000 costs. 

When delivering the verdict the jury foreperson said that they "attach no personal culpability to Commander Dick". 

Prior to sentence the Judge made lengthy comment. This will need careful consideration in light of all the evidence that has emerged during the trial and recommendations made by the IPCC in their report. The Judge stated this was, "an isolated breach brought about by extraordinary circumstances" and that the MPS has a good safety record. He also stated that this was a corporate failing and that he was not naming any individuals as having failed. 

The Commissioner was present in court when the verdict and sentence was delivered and a briefing is planned for all OCU Commander and equivalents early next week to highlight some of the potential implications of the guilty verdict. It should be noted that a considerable amount of work has been undertaken since July 2005 to develop our response to such incidents.
